These Terms & Conditions apply to any purchase made through Lataru. By accessing our website or placing an order, you agree to these terms and confirm that you are a consumer acting for personal use only. We recommend reading them carefully so you fully understand your rights and obligations.

Article 1. Definitions

Throughout these Terms, references such as “you,” “your,” or “the consumer” refer to the individual purchasing products for personal use. “We,” “us,” or “the merchant” refers to Lataru. A “distance contract” refers to any agreement completed online without face-to-face interaction. A “cooling-off period” refers to the time in which a consumer may cancel a purchase. A “durable medium” means any method allowing you to store information for future reference.

Article 2. Applicability of These Terms

These Terms apply to every offer we present and to every final order. Before completing a purchase, you can access these Terms online. If needed, we can provide a digital or physical copy upon request. If additional conditions apply to specific products or services, the most favorable version for the customer will always take precedence if a conflict arises. If any part of these Terms becomes invalid, the remaining provisions will continue to apply. Any unclear situations must be interpreted in the spirit of these Terms.

Article 3. Our Offers

Unless explicitly stated otherwise, all offers on our website are non-binding and may be updated or adjusted. We strive to describe our products as accurately as possible. Product photos reflect the actual items as closely as possible, but small differences in color or appearance may occur depending on screen settings. Such minor variations do not entitle the customer to compensation or cancellation.

All essential details of an offer — such as pricing, shipping costs, delivery expectations, and payment instructions — are always clearly disclosed during checkout. International customers are responsible for any import duties, customs-related handling fees, or taxes charged by their local carrier.

Article 4. Formation of the Agreement

Once you complete the checkout process and meet the required conditions, the agreement becomes final. If your order is submitted electronically, you will receive a confirmation email. Until this confirmation is received, you may cancel the order. Lataru uses secure systems to protect your personal and payment data. If we have reasonable grounds to believe that an order poses a fraud risk or cannot be fulfilled responsibly, we may decline or cancel it. If this happens, you will be notified immediately.

After purchasing, you will receive confirmation containing our contact information, details on how to exercise the right of withdrawal, warranty conditions, and information relevant to long-term agreements (if applicable).

Article 5. Right of Withdrawal

You may cancel your purchase within 14 days after receiving your order. During this period, you may inspect the product only to the extent necessary to determine whether you wish to keep it. To exercise this right, you must notify us by email within the 14-day window. Once you inform us of your cancellation, you have another 14 days to return the product. You must be able to provide proof of return shipment. If you fail to notify us or return the item within the required timeframe, the purchase becomes final.

Article 6. Cost of Returns

If you choose to withdraw from the purchase, you will be responsible for the return shipping costs. We will refund your payment within 14 days after receiving the returned item or after receiving proof that it has been shipped back to us. Refunds are issued using the same payment method used to place the order unless otherwise agreed.

Article 7. Exceptions to the Right of Withdrawal

Some items cannot be returned. The withdrawal right does not apply to personalized items, products made to your specifications, hygiene-sensitive products with broken seals, goods that spoil quickly, or sealed media such as software or audio/video content once opened. Services tied to specific dates or periods, such as travel or entertainment, are also excluded once fulfilled.

Article 8. Pricing

Prices displayed on our website remain valid for the duration of the offer unless legal requirements force adjustments. Because we ship internationally, carriers may charge import duties, clearance fees, or local taxes upon delivery; these are always the customer’s responsibility. We are not responsible for typographical errors or misprints. In such cases, we are not obligated to fulfill orders at incorrect pricing.

Article 10. Warranty & Product Expectations

We guarantee that products delivered by Lataru meet the specifications described at the time of purchase and are suitable for normal use. Any defects or incorrect deliveries must be reported to us within 14 days of delivery. Returned items must be unused and in their original packaging unless the defect prevents this.

Warranty does not apply if the product has been altered, repaired, or damaged due to improper use. We are not responsible for suitability for any specific purpose other than ordinary use unless explicitly stated.

Article 11. Delivery & Fulfillment

We take great care in handling and processing orders. Delivery takes place at the address you provide during checkout. Accepted orders are normally fulfilled within 30 days unless a longer delivery time is communicated and accepted by the consumer. If delays occur, you will be notified. In such cases, you may cancel the purchase at no cost, and we will refund you within 14 days.

If an ordered product is unavailable, we will attempt to provide a suitable replacement. You will be informed of this at the time of delivery. You may choose to return the replacement item without restrictions. The risk of loss or damage transfers to the customer upon delivery unless otherwise stated.

Article 12. Long-Term Agreements and Subscriptions

For agreements that involve recurring deliveries or long-term commitments, you may cancel at any time with a notice period of no more than one month. Subscription offers will not be automatically extended without clear communication. Trial subscriptions end automatically unless stated otherwise. Agreements lasting longer than one year may always be canceled after the first year with one month’s notice.

Article 13. Payments

Unless otherwise stated, all payments must be completed at checkout. You are responsible for ensuring that your payment details are correct. If payment fails or is reversed, we may recover administrative fees or decline future orders.

Article 14. Complaints

If you experience issues related to your order, you must report them to us within 7 days after discovering the problem. We respond to all complaints within 14 days. If additional investigation is required, we will inform you and provide an estimated timeframe for resolution. A complaint does not suspend your payment obligations. If the complaint is justified, we will repair or replace the product free of charge.

Article 15. Legal Disputes

All agreements with Lataru are governed by Dutch law, even if the customer is located in another country.

Article 16. CESOP

In accordance with European regulations related to the Central Electronic System of Payment Information (CESOP), payment service providers may record and share transaction data to enhance transparency and prevent fraud.
